BER encoding of password in simple bind in bindrequest ?

Can anyone explain why the encoding of the password when using simple bind is:

.. , 0x80 (the tag for context specific choice 0), length of pw, pw ...

and not:

.. , 0x80, 0x04 (the tag for an octet string), length of pw, pw ...
