need a gdb backtrace.  In principle, a modify should have a non-empty
modlist, unless it represents a "touch" (in which case, only operational
attrs like modifyTimestamp and so appear, but they would be generated by
the database so they would not be in place when the overlay is called.
In any case, I think that check should be removed from slapo-unique(5).
This however doesn't explain how an attribute with no values can be
found later on by entry_schema_check(); that's why a stack backtrace,
and a small, self-contained example may help.
