This is now fixed in CVS, thanks for the report. Note that there is no 
problem here in the 2.3 release. You can get the patch from CVS using
    cvs diff -r1.24.2.32 -r1.24.2.33 syncrepl.c
in the servers/slapd directory if you want to test it.
